Terms & Conditions

 These are our terms and conditions of sale, which will apply to all contracts with our customers placing an order with us (Stakehill Nurseries Ltd). These terms and conditions prevail over and are to the exclusion of all other contractual terms unless expressly agreed by us in writing.

Delivery:

1.1 We deliver to the UK mainland only. We do not deliver to any offshore destination.

1.2 To ensure the safe arrival of your parcel please make sure that ALL delivery information and contact information is accurate.

1.3 A signature will be required for items dispatched via our chosen courier service so you will need to be present (or someone on your behalf) to accept the parcel.  If this is not possible, a card will be left if you are unable to sign for the parcel with further delivery information on.

1.4 All delivery dates are not exact and are weather-dependent.  All plants are packed carefully to ensure they arrive safely and healthily.  Please be aware that during busy periods there could be a slight delay in the delivery of your parcel, we ask that you bear this in mind. If you require a specific delivery date, we cannot be held responsible if your item doesn't arrive to you by your chosen date.

1.5 Plants are living items that need to be treated with care.  If we believe that conditions aren't suitable to dispatch your plant(s) then we reserve the right to delay the dispatch until conditions improve.  We ask for your understanding as we want all plants to arrive in best possible condition.

1.6 Should any delays to dispatch occur you will be notified by telephone or email.  Larger orders travelling on a pallet will not be dispatched until we have arranged a suitable delivery date as re-delivery will unfortunately incur further charges.

1.7 Items being shipped to Northern Ireland, the Channel Isles, the Isle of Man, Isle of Wight and the Scottish Island may be subject to delivery surcharges.

 

2. Availability, price and VAT:

2.1 Your order is accepted subject to availability. VAT is included on all prices displayed on the website.

2.2 All items are in stock at the time of listing, and if the item is unavailable at the time of your order then we reserve the right to refund for the individual item upon the dispatch of the remainder of your order.

 

3. Substitution and sizing:

3.1 All plants are living items and no two products that we sell are guaranteed to be identical.  We can guarantee that all of our plants however are quality, well grown and have good strong roots.

3.2 All plants are measured from the top of the pot to the very top of the plant.

3.3 If a plant you have ordered is no longer available in the size you require, when possible it may be replaced by the same plant but in a larger size, at no further price charge

 

4. Payment and title:

4.1 Payment is due with order. We will not dispatch any items until full payment is received.  We do not accept cash upon the delivery of your item.

 

5. Complaints, guarantee and liability:

5.1 Plants are of high quality and healthy, and we package them to arrive to you in the same condition.

5.2 If an item arrives damaged to you then you need to contact us immediately via email or telephone and we will do our best to rectify the situation. In cases we see fit, when a replacement may not be sent a refund will be issued.

5.3 We describe the plants as accurately as possible and all are healthy items with good root systems.  Upon inspecting your items if you are unhappy, then you are required to contact us via email or telephone within 24 hours.

5.4 Upon receiving your order if you decide they are not to your specification then you can return the plant (after informing us of your intentions) to us at your own expense.  It must arrive back to us in the condition it left us.

5.5 Once planting your items you are recognising that we are no longer responsible for the conditions in which they are kept.  We have no control over weather, climate, conditions they are planted or how you care for them.  Their health and upkeep is your sole responsibility.

5.6 This guarantee in no way affects your legal rights, but it is subject to all the plants you purchase being planted and looked after in line with the plant care information we provide with your order.

5.7 Our liability is restricted to the replacement or refund of any goods we have sold and delivered.  Any plants that are returned and found to be in good, healthy conditions or returned as they are no longer required, are shipped at the cost of the customer.

 

6. Christmas Trees:

6.1 All of the Christmas trees that we sell are of the highest quality and all sizing in respect is approximate.  Potted trees are measured from the top of the pot to the top of the tree.

6.2 All shapes, density and colour may vary from tree to tree and we are not responsible for any Christmas tree not meeting a customers expectation in this respect.  We take accurate photographs but cannot guarantee that the tree in the photograph is the exact one you will receive.

6.3 Christmas trees need a sufficient amount of water upon setting up the tree after delivery.  We cannot be held responsible for the effects your local climate may have upon your tree.  Failure to supply your tree with an adequate supply of water will greatly reduce its life span.

6.4 All delivery costs shown (and paid) are for delivery to your front door only.  It does not include the setting up of your tree or taking it to your preferred room in your home.

6.5 If you have a specific delivery date please inform us immediately upon checkout so that we can reserve your tree until suitable to dispatch.  Due to the peak season, please bear in mind that once the tree leaves our nursery it may be subject to a slight delay, where this occurs we are not responsible should the tree not arrive to you on your preferred date.

6.6 If you refuse the delivery of your Christmas tree for any reason other than the tree itself is damaged you will be refunded minus shipping costs.

 

7. Privacy:

7.1 We keep your details. These let us send you catalogues and any information on current offers we may have. We never share them with third parties. If you do not wish to receive catalogues and other communications from us, please let us know at the time of placing your order.
